The Jamuna Group appealed against a High Court order that dismissed a previous petition challenging an order to demolish unapproved upper floors of its mega mall, Jamuna Future Park.
The demolition order was initially issued by Rajuk, the capital's development authority, on Jan 17.
Appellate Division chamber justice Md Muzammel Hossain sent the appeal to the regular bench on Sunday.
Ahsanul Karim, lawyer for Jamuna Group told reporters that as they did not get approval to file the petition on Thursday, it was not in Sunday's cause list.
Barrister Rafiq-ul-Huq is also arguing for Jamuna Group.
Attorney general Mahbubey Alam and ASM Mesbah Uddin are representing the state.
Rajuk on Feb 4 began demolishing the unapproved top floors of the Future Park just a day after the High Court dismissed its petition.
Rajuk gave the Future Park authorities seven days' notice before knocking down the unauthorised parts of the shopping complex claimed to be the largest in South Asia.
